This notice explains the limits of PDA Australia’s articles, free resources, templates, scripts, guides and paid digital products.

Please read this notice carefully. It applies to your use of the PDA Australia website at https://pdaaustralia.com.au and to every article, free resource, template, script, checklist, guide, example and paid digital product we provide (together, the Resources). In this notice, “we”, “us” and “our” mean PDA Australia. By accessing the website or using any Resource, you acknowledge that you have read, understood and accepted this notice.
General information only
The Resources provide general educational and informational content about PDA, autism, school support, family support and preparation for NDIS-related processes. They are general in nature only.
The Resources do not take into account your particular circumstances — including any individual diagnosis, support needs, risk profile, school or workplace environment, funding situation, legal position, family circumstances or need for professional advice. You are responsible for deciding whether any Resource is appropriate for your situation, and for obtaining your own advice before acting.
No professional relationship
Accessing the website or using any Resource does not create any professional, clinical, advisory, therapeutic, fiduciary or client relationship between you and us. We are not acting as your adviser, clinician, advocate, support coordinator or representative, and you should not treat any Resource as a substitute for individualised professional advice or services.
Nature of the information about PDA
“PDA” (often called Pathological Demand Avoidance, or a demand-avoidant profile) is described in the literature as a profile of needs associated with autism. It is the subject of ongoing professional discussion, and it is not currently a separate, standalone diagnosis in the major diagnostic manuals (the DSM-5-TR or the ICD-11). Professional opinion about how PDA should be understood, identified and supported varies.
Our Resources reflect a practical, support-focused approach. They are not a clinical authority on PDA or autism, do not establish that any person has PDA or any other condition, and should not be read as asserting a settled clinical or diagnostic position. Always rely on a qualified professional for assessment and diagnosis.
Not medical, psychological, therapeutic or diagnostic advice
We do not provide medical, psychological, psychiatric, therapeutic, behavioural, developmental, diagnostic or other clinical advice or services.
Nothing in the Resources should be used to diagnose, assess, treat, manage, prevent or cure any medical, developmental, psychological, behavioural or mental health condition. Seek advice from a qualified health, allied health, mental health, developmental or educational professional about your individual circumstances, and do not disregard or delay seeking professional advice because of something you have read in a Resource.
Not legal, financial or NDIS advice
We do not provide legal, financial, plan-management, support-coordination, advocacy or formal NDIS advice.
Information about the NDIS — including access, funding, evidence, reports, planning, reviews, reassessments, support categories and related processes — is general educational information only. NDIS legislation, rules, operational guidance and decisions change over time and are applied to the specific facts of each case. For advice about your situation, contact the National Disability Insurance Agency (NDIA) or a suitably qualified legal professional, registered provider, support coordinator, plan manager, financial adviser or advocate.
No guarantee of outcomes
We do not promise, predict or guarantee that using any Resource will produce any particular result. This includes (without limitation) outcomes relating to NDIS access or funding, plan reassessments, school adjustments, behaviour support, professional reports, service access, child wellbeing, classroom outcomes or the resolution of conflict.
Any statement about a possible future outcome is a general illustration only, based on assumptions that may not apply to you. It is not a representation or warranty that any outcome will be achieved. Every child, family, school, professional, participant and decision is different, and many factors outside our control affect results.
Emergency, crisis and safety situations
We are not an emergency, crisis, counselling or clinical support service, and the Resources must not be relied on in an emergency or crisis.

School and professional use
Teachers, schools, support staff and other professionals may use the Resources as general educational information and as practical discussion tools.
Resources must be adapted to the individual student, family, setting and your own professional obligations. They do not replace school policies, child-safety requirements, disability standards obligations, professional judgement, individualised planning, clinical advice, legal advice, or formal assessment and behaviour-support planning where those are required. You remain solely responsible for your professional decisions.
Digital products, downloadable resources and your consumer rights
Paid digital products and free downloadable Resources are provided for personal, family, educational or professional use, subject to any terms stated on the relevant product or resource page.
Your consumer guarantees. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this notice or in any product terms excludes, restricts or modifies those guarantees. Where we supply a paid digital product to you as a consumer, it comes with guarantees including that it will be of acceptable quality, will match its description, and (where you have told us a particular purpose, or it is reasonably apparent) will be reasonably fit for that purpose, and that related services will be supplied with due care and skill.
Remedies and refunds. If a Resource fails to meet a consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law, which may include a repair, replacement, resupply or refund. Because of the nature of digital products, please contact us at hello@pdaaustralia.com.au if you experience a problem so we can address it. Nothing on a sales page or in any product term is intended to suggest you have fewer rights than the law provides.
Permitted use. You may not resell, repackage, redistribute for commercial gain, claim authorship of, or substantially reproduce our Resources without our written permission. Free Resources may be downloaded, printed and shared for non-commercial educational or support purposes, provided they are not altered, misrepresented, sold or presented as your own work.
Reviews, testimonials and examples
Any reviews, testimonials, case studies or examples that appear in the Resources reflect the individual experience of the person who provided them at a particular time. They are not a promise, prediction or guarantee that you will obtain the same or a similar result. Examples are provided to illustrate general concepts only and may be composite or simplified.
Accuracy and currency
We aim to provide useful, practical and current information, but we make no representation or warranty that any Resource is complete, accurate, current or suitable for your circumstances. Information may become out of date — particularly where it relates to NDIS processes, education systems, policy, funding rules, terminology or external services. We may update, replace or remove content at any time without notice.

The website may contain links to, or content from, third-party websites, organisations, products, services or resources. These are provided for convenience and general information only. We do not endorse, and are not responsible for, the accuracy, availability, policies, content, advice, products, services or practices of any third party. Your dealings with any third party are at your own risk and subject to that third party’s terms.
Limitation of liability
Australian Consumer Law not excluded. Nothing in this notice excludes, restricts or modifies any guarantee, right, warranty or remedy that you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law, where doing so would be unlawful.
Exclusion. Subject to the paragraph above, and to the maximum extent permitted by law, we are not liable for any loss, damage, cost, claim or expense (including indirect or consequential loss) arising out of or in connection with your access to or use of, or your inability to use, the website or any Resource, or your reliance on any information in it, whether in contract, tort (including negligence), statute or otherwise.
Limitation. Where we are liable for a failure to comply with a consumer guarantee that cannot be excluded, and the relevant goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, to the extent permitted by law and at our option, to resupplying the goods or services or paying the cost of having them resupplied. In any other case where liability can lawfully be limited, our total aggregate liability is limited to the amount you paid us (if any) for the relevant Resource.
Your responsibilities and indemnity
You are responsible for how you use the Resources and for any decisions you make. To the maximum extent permitted by law, you agree to indemnify us against any loss, damage, cost or claim arising from your misuse of the Resources, your breach of this notice, or your infringement of our or any third party’s rights — except to the extent the loss is caused by our own breach, negligence or wilful misconduct.
Intellectual property
Unless otherwise stated, all website content, articles, downloadable Resources, templates, scripts, product content, design elements and written materials are owned by us or used with permission. You must not copy, reproduce, modify, distribute, sell, license, publish or commercially exploit our content without our written permission, except as expressly allowed for free Resources or as permitted by law.
Privacy
If you contact us, purchase a product, subscribe to updates or submit information through the website, we may collect and handle your personal information in accordance with our Privacy Policy and applicable privacy law, including the Privacy Act 1988 (Cth) where it applies.
Changes to this notice
We may update this notice at any time by publishing a revised version on the website. The version in force is the one published at the time you access the website or use a Resource. Material purchases are governed by the version current when you made your purchase. Please review this notice periodically.
Governing law and jurisdiction
This notice is governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.
Severability
If any part of this notice is found to be void, invalid or unenforceable, that part is to be read down to the extent necessary, or severed, so that the rest of this notice continues to operate to the maximum extent permitted by law.
No waiver
If we do not exercise or enforce a right available to us under this notice, that does not amount to a waiver of that right.
How this notice applies and acceptance
By accessing the website, reading articles, downloading Resources, purchasing a product or otherwise relying on any Resource, you acknowledge that you have read and understood this notice and agree that the Resources are general only and must not replace appropriate professional advice. For paid products, you accept this notice and any product terms at the time of purchase.
